10. Dispute Resolution and Arbitration
10.1 Informal Resolution

EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT AND DISPUTES THAT CANNOT BE ARBITRATED AS A MATTER OF LAW, ANY DISPUTE THAT CANNOT BE RESOLVED INFORMALLY SHALL BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) UNDER ITS CONSUMER ARBITRATION RULES THEN IN EFFECT. THE ARBITRATION SHALL BE CONDUCTED IN ENGLISH AND SHALL TAKE PLACE IN THE APPLICABLE JURISDICTION OR, AT EITHER PARTY'S ELECTION, TELEPHONICALLY OR VIA VIDEO CONFERENCE.
The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. The arbitrator shall have the authority to award any remedy that would be available in a court of law, except that the arbitrator may not award punitive damages in excess of what is permitted by applicable law.
10.3 Class Action Waiver
YOU AND TATTE BAKERY & CAFE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. THIS WAIVER APPLIES TO CLASS ARBITRATION AND ALL OTHER FORMS OF REPRESENTATIVE PROCEEDINGS.
10.4 Jury Trial Waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND TATTE BAKERY & CAFE HEREBY IRREVOCABLY WAIVE ALL RIGHTS TO A TRIAL BY JURY IN ANY DISPUTE ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES.
